- Key facts
- Promotion and Regulation of Online Gaming Act 2025 (Act No. 32 of 2025, presidential assent 22 August 2025). PROG Rules 2026 notified by MeitY, in force on 1 May 2026; creation of the OGAI (6 members, chaired by an Additional Secretary of MeitY). Offering, facilitating payments for or advertising online money games: up to 3 years' imprisonment and a fine of 1 crore INR; blocking under the IT Act 2000. Federal law takes precedence over State frameworks: Sikkim's online gaming licences (State intranet) and Nagaland's skill-gaming licences no longer allow online money games to be offered; Goa keeps only land-based casinos (Goa Public Gambling Rules approved in March 2026, age raised to 21). Constitutional challenge: the Supreme Court (CJI Surya Kant, J. Bagchi) admitted the petitions for final hearing in August 2026, with no known interim stay. MeitY has warned VPN providers that give access to illegal platforms. [sources consulted on 2 October 2026]
What a player risks
Online casino gambling is prohibited in this market; no operator is licensed to offer it. A site that takes players from this market does so without any local licence, whatever licence it holds elsewhere: its players have no local-regulator protection or dispute resolution, and deposits, payments or winnings may be blocked or confiscated. Depending on local law, playing may itself be an offence and may lead to fines or prosecution. The register records for India: Illegal and blocked: offshore sites (Curaçao, Anjouan, etc.) targeting India are illegal under the PROG Act and blocked en masse; operators, promoters, influencers and payment intermediaries are liable to prosecution. The law targets the offering, facilitation and advertising; the sources consulted do not mention a specific penalty for the ordinary player. Offshore gambling remains massive (circumvention via mirror domains and UPI).
