Key facts
Monopoly until further notice: win2day (Österreichische Lotterien) remains the only legal online casino. Reform of the GSpG: draft published on 1 July 2026, notified to the European Commission on 4 August 2026 (3-month standstill); vote in the Nationalrat expected in November-December 2026. Announced timetable: technical standards published between the 1st and the 3rd quarter of 2027, submission of online licence applications from 1 October 2027, first licences expected between late 2027 and mid-2028 (rolling procedure). The win2day concession normally expires on 30 September 2027 but is to be extended by law until 31 December 2028. Operators without an Austrian concession must cease their offering by 1 January 2027 at the latest if they wish to apply (otherwise an exclusion period). 1 October 2027 is therefore the date on which applications open, not that of a multi-operator market already in operation.

What a player risks

Online casino games in this market are reserved to the state operator. No other site is licensed to offer them, and a licence issued elsewhere, offshore or foreign, does not make play legal where the offer is reserved to a monopoly. A site outside the monopoly is not supervised by the local regulator: its players have no access to that regulator's protection or dispute resolution, and deposits, payments or winnings may be blocked or confiscated. Depending on local law, using such a site may also lead to fines or prosecution. The register records for Austria: Illegal for the operator (offering without an Austrian concession); the player is not penalised. According to the OGH (monopoly held to be compatible with EU law, e.g. 6 Ob 31/24p), the gambling contract with an offshore casino (Malta, Curaçao…) is void and the player may recover their losses (unjust enrichment); the CJEU (C-77/24, January 2026) allows the player to bring proceedings before the court of their place of residence. Blocking of IP addresses and payments provided for by the 2026-2027 reform; 'clean slate' for former illegal operators that pay their tax arrears and comply with players' judgments.
